Marijuana Case Dismissed and Deportation Order Terminated

John Doe was held for a year in immigration custody as a result of his guilty plea to possession with intent to distribute marijuana.

Attorney White filed a motion to vacate the guilty plea based on misconduct at the Hinton lab days before Mr Doe was scheduled to be deported.  As a result of the motion, the immigration court stayed his deportation proceeding. Mr Doe was released and brought home to his family.

Attorney White subsequently prevailed in her motion to vacate this guilty plea and obtained a dismissal of the original distribution charges.

After the dismissal, Attorney White filed a motion to terminate Mr Doe’s immigration proceeding with the Board of Immigration Appeals with an extensive brief and supporting exhibits.

The motion to terminate was allowed, the deportation case has been permanently closed and Mr Doe’s permanent legal residency has been restored.
