Cocaine Distribution Charges Dismissed with Prejudice

In 2010, John Doe was arrested and plead guilty to distribution of cocaine in the Lynn District Court.

In 2015, John Doe was arrested for a second subsequent offense and indicted in Suffolk Superior Court.

Attorney White prevailed with a motion to vacated his original plea, on grounds that the Commonwealth of Massachusetts withheld exculpatory evidence from the defendant. The withheld evidence was related to the misconduct of disgraced chemist Annie Dookhan of the Hinton Drug Lab.

Because the original plea was vacated, the District Attorney had no choice but to dismiss the second subsequent indictment in the superior court.

The original drug case in Lynn District Court was also subsequently dismissed with prejudice by the Supreme Judicial Court.
