John Doe was indicted with trafficking in cocaine after he was pulled over by the police based on his failure to signal and having excessive window tints. The defendant consented to the search of his car, which K-9 dogs later unveiled about 80 grams of cocaine in hidden in the back trunk. John Doe was facing seven years of mandatory jail time.
White & Associates was able to show that the police’s search of John Doe’s car was unconstitutional because the police’s detention of the defendant was beyond the scope of the initial motor vehicle infraction. This resulted in the court to order the evidence of the 80 grams of cocaine to be suppressed, and the district attorney dropped the case by filing a Nolle Prosequi.
