Case Dropped: Possession with Intent to Distribute Cocaine and Possession of Percocets

John Doe was charged with possession with intent to distribute cocaine and possession of Percocets. Mr Doe’s arrest came while he was driving his car, and after he was pulled over by a police officer.

As part of her defense strategy, Attorney Veronica White of White & Associates P.C. filed a motion demanding all computer queries conducted by the officer officer who stopped and searched Mr Doe. Despite the objections of the District Attorney, the court ordered the Massachusetts Department of Criminal Justice Information Services to provide Attorney White with these records. Attorney White also obtained a transcription of the radio transmissions of the officer.

The motor vehicle queries and the radio transcripts contradicted the chronology of events as described in the police report, indicating the arresting officer was not being truthful and had violated police procedure.

Attorney White was then able to suppressed the evidence of cocaine and Percocets that were found as a result of the inventory search. The District Attorney was forced to drop the narcotics charge against Mr Doe, who was then free to go.
