Distribution Class A and Possession With Intent to Distribute Heroin Within 100 Feet of a Park Dismissed

In 2014, John Doe was charged in the Dorchester division of the Boston Municipal Court with Distribution of Heroin and Possession with Intent to Distribute Class A within 100 feet of a park. Attorney White and Attorney Leatherman demonstrated various issues with the Commonwealth’s discovery, sought sanctions for non-compliance with discovery orders and ultimately moved to suppress the evidence seized by law enforcement. On the third time that Mr. Doe’s motion to suppress was scheduled, Attorney White convinced the Court to dismiss all charges on grounds that the Commonwealth had failed to comply with an order of the Court.  The case was dismissed without prejudice and Mr. Doe was free to go.
