Assault & Battery with Dangerous Weapon Dismissed

John Doe was charged with hitting a biker with his motor vehicle in Cambridge, Massachusetts.
Attorney White filed a discovery motion and litigated a motion to suppress evidence.
The Court allowed a portion of the motion to suppress and struck portions of the police report from evidence.
An investigation ensued, witnesses were served in hand and Attorney White was ready for trial. The district attorney was placed on notice that a witness on scene would testify in diametric opposition to what the victim would say. The case was dismissed after the Commonwealth answered “not ready” for trial.
