John Doe was arrested and detained for the charges of rape, two counts of assault and battery with a dangerous weapon, assault and battery and malicious destruction of property after an extensive report was made to the Burlington Police Department and Boston Police Department.
Attorney Veronica J White filed detailed motions for an evidentiary hearing with affidavits of counsel in support of vacating the order of dangerousness.
As a result, the Middlesex County District Attorney’s Office dropped (nolle prosequi) the rape charge and Mr. Doe was promptly released.
Next, Attorney White filed a significant amount of discovery motions. White & Associates also started an interstate investigation of the alleged victim.
Attorney White pressed for a trial. The alleged victim exercised her fifth amendment right to counsel and did not testify against Mr. Doe. The charges against Mr. Doe were then dismissed without prejudice.
